Matrimonial Finances
Reaching a financial settlement is always a cause of major concern upon separation. The financial position changes and you are concerned to maintain a home and a reasonable standard of living.
We have a great deal of experience in negotiating financial settlement to our clients’ satisfaction. We are accustomed to dealing with clients with complex financial affairs, (including business, farms, Trusts etc) from where substantial sums are involved to where the only asset is the home. Our aim is deal with your case by robust negotiations so as not to be ambushed by the other side but with a view to keeping matters as amicable as possible ensuring that your case is not unduly drawn out. This is even more important if children are involved. Their welfare will be a vital consideration in the financial settlement.
To ensure a fair settlement we need to have a clear and accurate picture of the assets of each partner, inclusive of pensions. Full and frank disclosure of the information must be provided. Once obtained negotiations can commence to arrive at a settlement. Most cases settle at this stage. In the circumstance that either full disclosure is not provided and/or settlement cannot be agreed, then the matter will have to be pursued through the Courts.
