Court of Protection
The Court of Protection has the power to make decisions regarding the property and affairs of adults (and in some cases children) who lack mental capacity to make these decisions for themselves.
In cases where there is no Lasting Power or Enduring Power of Attorney present, the Court of Protection will need to oversee the financial affairs of any individual who lacks mental capacity and it may be necessary to apply to the Court to appoint a Deputy.
